1. Acceptance of Terms
By creating an account, downloading, accessing, or using the Hiya (هِيَ) mobile application or the website hiyakw.com (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you must not access or use the Platform. Your continued use following any updates constitutes your acceptance of the revised Terms.
These Terms constitute a legally binding agreement between you and Hiya (هِيَ), a company operating in the State of Kuwait. Company registration details will be updated upon completion of Commercial Registration (CR) with MOCI Kuwait.
These Terms should be read in conjunction with our Privacy Policy and Cookie Policy, which form part of this agreement.
2. Account Registration & Eligibility
2.1 Eligibility
To use Hiya, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement under the laws of the State of Kuwait.
2.2 Registration
To access Hiya's features, you must create an account using email and password, Google Sign-In, or Apple Sign-In. You agree to provide accurate, current, and complete information during registration.
2.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at if you suspect unauthorized access. Hiya is not liable for any loss arising from unauthorized use of your account.
2.4 One Account Per Person
Each individual may only maintain one active Hiya account. Creating multiple accounts may result in suspension or termination.
3. Health Data Disclaimer
- Cycle Predictions: AI-generated statistical estimates. Should not be relied upon for contraception or clinical decisions.
- Fertility Window Mapping: Informational only. Not a substitute for professional fertility assessment.
- Symptom Pattern Recognition: Identifies trends in self-reported data. Does not constitute a medical diagnosis.
- Phase-Based Recommendations: General wellness suggestions, not prescribed medical treatments.
- Provider Matching: Based on preferences and cycle phase. Hiya does not evaluate providers' medical qualifications.
Always consult a qualified healthcare professional for medical decisions. If you experience concerning symptoms, seek medical attention immediately.
4. Demo Mode & Beta Disclaimer
4.1 What Demo Mode Means
- No real payments are processed. All transactions are simulated.
- No real bookings are created with providers. Demo bookings are marked with an orange "DEMO MODE" banner.
- Demo bookings are flagged with
isDemo: trueand will not result in actual appointments.
4.2 Beta Testing
As a beta tester, you understand that the app may contain bugs or incomplete features, features may change without notice, data entered during beta may not be preserved, and Hiya is not liable for data loss or inaccurate predictions during beta.
4.3 Transition to Production
When Hiya transitions to live operations, we will notify all users and provide updated Terms. You will be asked to accept the updated Terms before using live features.
5. User Conduct & Content Policies
5.1 Acceptable Use
Use the Platform only for personal wellness tracking and booking services. Provide accurate information. Treat providers and users with respect. Comply with Kuwait law.
5.2 Prohibited Conduct
- Use the Platform for any unlawful purpose
- Impersonate another person or misrepresent your identity or age
- Share your account credentials
- Harass, threaten, or send abusive messages to providers or users
- Submit false or fraudulent reviews or ratings
- Circumvent the Platform to arrange off-platform payments
- Reverse engineer, decompile, or tamper with the app
- Use automated tools, bots, or scrapers
- Upload viruses, malware, or harmful code
- Collect or harvest other users' personal data
- Promote competing services
5.3 User-Generated Content
Reviews, ratings, or messages you submit grant Hiya a non-exclusive, royalty-free license to display this content within the Platform. Hiya reserves the right to remove violating content.
5.4 Enforcement
Violations may result in a warning, temporary suspension, or permanent termination of your account.
6. Provider Relationship
6.1 Provider Independence
Each provider operates independently and is solely responsible for: quality, safety, and delivery of services; maintaining licenses, certifications, and insurance; compliance with Kuwait Ministry of Health regulations (including Resolution No. 194/2025); and accurate representation of services, pricing, and availability.
6.2 No Endorsement
Listing on Hiya does not constitute an endorsement. We perform basic verification during onboarding but do not independently verify every provider claim.
6.3 Disputes with Providers
Attempt to resolve disputes directly with the provider first. Contact for mediation assistance. Hiya is not obligated to resolve user-provider disputes.
7. Booking & Cancellation Policies
7.1 Booking Confirmation
A booking is confirmed when you receive a confirmation notification. Hiya implements conflict prevention to avoid double-bookings.
7.2 Cancellation Policy

7.3 No-Shows
No refund for no-shows. Repeated no-shows may result in booking restrictions.
7.4 Provider Cancellations
If a provider cancels, you receive a full refund regardless of timing, plus immediate notification.
8. Payment Terms
8.1 Current Status (Demo Mode)
While in demo mode, no real payments are processed. All payment flows are simulated.
8.2 Future Payment Processing
- Processor: Tap Payments, regulated by the Central Bank of Kuwait.
- Methods: KNET, Visa, Mastercard, and Apple Pay.
- Card Security: Hiya never stores card details. All card data is handled by Tap Payments (PCI-DSS compliant).
- Platform Fee: Included in displayed price. You see the total before confirming.
- Currency: All prices in Kuwaiti Dinar (KWD).
8.3 Refund Processing
Approved refunds processed within 5-10 business days to the original payment method.
9. Memberships & Subscriptions
9.1 Provider Memberships
Some providers offer recurring memberships (gym access, meal plans). Manage these in "My Memberships."
9.2 Hiya Insights+ (Premium)
Optional premium tier with symptom-to-phase correlation, fertility window mapping, AI monthly reports, HealthKit-enhanced predictions, and partner sharing. Pricing shown in-app.
9.3 Cancellation
Cancel any subscription at any time. Access continues until the end of the current billing period. No partial refunds for unused time.
10. Intellectual Property
All content, design, code, branding, and materials on the Hiya Platform — including the name "Hiya" (هِيَ), logos, UI design, and AI algorithms — are the exclusive property of Hiya and are protected by applicable intellectual property laws.
You retain ownership of all personal data you submit. By using the Platform, you grant Hiya a limited, non-exclusive license to process this data solely for providing our services.
11. Limitation of Liability
To the maximum extent permitted by Kuwait law:
- The Platform is provided "as is" and "as available" without warranties of any kind.
- Hiya is not liable for the quality, safety, or outcome of wellness services booked through the marketplace.
- Hiya is not liable for the accuracy of AI predictions, fertility estimates, or wellness recommendations.
- Hiya is not liable for health decisions made based on Platform information.
- Total liability shall not exceed fees paid to Hiya in the 12 months preceding the claim.
- No liability for indirect, incidental, special, consequential, or punitive damages.
12. Governing Law (Kuwait)
These Terms are governed by the laws of the State of Kuwait. Disputes are subject to the exclusive jurisdiction of the courts of Kuwait City.
Before formal proceedings, both parties agree to attempt good-faith negotiation via . Hiya will respond within 30 days. If unresolved within 60 days, either party may proceed with legal action.
13. Termination
13.1 By You
Delete your account anytime via Settings. Your data will be deleted per the Privacy Policy (within 30 days). Active bookings will be cancelled. Subscriptions end at current billing period.
13.2 By Hiya
Hiya may suspend or terminate your account for: violating these Terms, fraudulent or illegal activity, safety risks, or legal requirements. We provide prior notice where possible.
13.3 Surviving Provisions
Limitation of Liability, Intellectual Property, and Governing Law sections survive termination.
14. Changes to Terms
- Material changes communicated via email and in-app notification at least 14 days before taking effect.
- Updated Terms posted at hiyakw.com/terms with a new effective date.
- Continued use after the effective date constitutes acceptance.
- If you disagree, stop using the Platform and delete your account.
